These Terms of Service (“Terms”) govern your access to and use of the website sandwauto.com (the “Site”) and any related services, including inquiries, parts requests, loyalty program participation, and text messaging programs (collectively, the “Services”).

About S&W Used Auto Parts

S&W Used Auto Parts (“S&W,” “we,” “us,” or “our”) provides used automotive parts and related services, including full-service parts sales, U-Pull inventory information, and customer support.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. By using the Services, you represent that you meet this requirement.

Website Use and Acceptable Conduct

You agree not to:

misuse the Site or attempt to gain unauthorized access to our systems, accounts, or data
interfere with the Site’s operation or security
upload or transmit malicious code, spam, or automated scraping tools without our permission
use the Site for unlawful purposes

We may restrict or terminate access if we believe you are violating these Terms or applicable law.

Product Listings, Inventory, and Accuracy

We work to keep listings and inventory information accurate, but inventory changes quickly. Availability, pricing, condition, mileage, interchange, photos, and descriptions may be incomplete or subject to change without notice.

No guarantee of availability: Items may sell at any time and may not be available when you contact us or arrive on site.
Fitment responsibility: It is your responsibility to confirm fitment/compatibility with your vehicle (VIN, trim, engine, transmission, and options) before purchasing or installing any part.

Quotes, Pricing, Taxes, and Fees

Quotes provided by phone, email, text, or online are estimates and may change due to availability, condition, market pricing, core charges, or other factors. Taxes, fees, shipping, delivery, and any core charges may apply.

Sales Are Final; Returns and Warranties

Used auto parts are sold “as-is” unless we provide a written warranty or return policy at the time of purchase.

All sales are final unless otherwise stated in writing on your invoice or warranty documentation.
If a warranty applies, it is limited to the terms provided at purchase and may require documentation, inspection, or return of the part.
We are not responsible for labor, towing, storage, diagnostic fees, installation, removal, downtime, or consequential damages unless required by law.

U-Pull Yard Rules

If you visit or use our U-Pull facility, you agree to follow posted rules and safety requirements. Entering the yard is at your own risk. You must use appropriate safety gear and follow staff instructions.

Local Delivery

Delivery availability, timing, and pricing may vary by location and operational constraints. Delivery estimates are not guarantees. Risk of loss may transfer according to the delivery method and terms provided at purchase.

Text Messaging (SMS) Terms

If you opt in to receive SMS/text messages from S&W, the following terms apply:

Types of messages: You may receive messages related to vehicle inventory alerts you request, customer care/follow-ups to your inquiries, Parts Plus loyalty updates, and marketing/promotional messages (sales, offers, contests) if you opted in to marketing.
Written consent: By providing your mobile number and opting in (for example, by checking a box on a form or otherwise affirmatively consenting), you provide your written consent to receive text messages from S&W at the number provided. Consent is not a condition of purchase.
Message frequency: Varies. Msg & data rates may apply. Opt-out: Reply STOP to unsubscribe at any time. You may receive a confirmation message.

Carrier notice: Carriers are not liable for delayed or undelivered messages.

Intellectual Property

All content on the Site (text, logos, graphics, photos, layout, and design) is owned by S&W or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.

Third-Party Links and Services

The Site may link to third-party sites or tools. We are not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, S&W AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES. IN ALL CASES, S&W’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO S&W FOR THE SPECIFIC PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM (OR $100 IF NO PAYMENT WAS MADE), UNLESS REQUIRED BY LAW.

Indemnification

You agree to indemnify and hold harmless S&W from claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from your violation of these Terms, misuse of the Site, or infringement of any rights of a third party.

Changes to the Site, Services, or Terms

Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in DeKalb County, Georgia, unless otherwise required by law.
